§ 1 Scope
The following General Terms and Conditions are valid for all the services organized by DeMedici srl (hereafter referred to as DeMedici) such as courses, events, lectures and exercises, which are offered to the participant.
§ 2 Registration and Signing the Contract
The participant can register by telephone, in writing, by Fax or by means of the forms published on the website, by entering the name, address, telephone number and all other required data.
With the confirmation of registration by DeMedici, the contract between the participant intending to attend one or more events (the subject of the present contract) and DeMedici is concluded and the registration is to be considered as binding.
The participants’ registrations are considered in the chronological sequence of their occurence until the maximum number of participants is reached.
§ 3 Cancellation before the start of the event, Non-participation, Right of withdrawal
The participant has the right to withdraw from this contract by means of a written notice:
- Provided that the notice reaches 4 weeks before the start of the DeMedici event, all the payments made to the contracting party in connection with the said event will be reimbursed.
- Provided that the written notice is received by DeMedici at least 7 days before the start of the event, the participant will be paid 50% of the participation fee.
- Provided that the written notice reaches within 7 days before the start of DeMedici event, the participant will be charged at full-cost.
The date of receipt of the written notice of cancellation of the participant (date of stamp of DeMedici incoming mail) will be considered as the date of cancellation.
Provided that the notice is delivered on a Friday, Saturday, Sunday or on a public holiday prevailing in the respective country, the working day following that holiday will be considered for the calculation of the date of cancellation.
For non-participation in the event, disruption of the participation or non-utilization of individual event contents, however the participant is obligated to pay DeMedici the entire event amount.
The participant also has the option to allow another person to participate in the event in his place, provided that that person fulfils the necessary prerequisites for participation and this information is notified to DeMedici in good time, in order to be able to make the necessary amendments therefore.
In case DeMedici employees hold events in participants’ surroundings, DeMedici usually books accommodation and flights and rents cars for the lecturer(s) several months before the event takes place. For this reason, from the moment DeMedici has issued the participant’s confirmation of registration, the participant has to pay the above mentioned costs also in case of a punctual rejection/non-participation or cancellation by him/herself. As evidence, DeMedici will present copies of the respective invoices to the participant.
§ 4 Postponement and cancellation of the events
Until the registration is not confirmed, DeMedici reserves the right to carry out amendments concerning event dates and prices according to the course offer, Internet or otherwise specified.
After signing the contract, DeMedici can make amendments, provided that these are inevitable, irrelevant, and do not violate the good will and do not have any negative effects on the overall content of the event, such as replacement of the lecturer or the like.
Furthermore, DeMedici reserves the right to cancel or postpone the events - even after the confirmation of the registration - for organizational or technical reasons, for example not getting the minimum number of participants or in the event of sickness of the lecturer.
Provided that one of the above mentioned points actually occurs, DeMedici will inform the participants as quickly as possible by telephone or in writing about the amendment. If necessary, the latter must make use of his rights immediately after receiving the notice by DeMedici.
If an event is cancelled, the participant has the option to use the event fee for another event or to demand the refund of the respective amount.
There is no right of compensation from the participants.
Amendments in the programme and agreements during the event due to unforeseen and unavoidable reasons are only allowed if these do not affect the basic items of the agenda of the event.
§ 5 Terms of payment
The participant will be informed about the participation fee along with the confirmation of registration. The invoice is sent depending on the respective agreed payment condition such as advance payment, direct debit, Cheque or the like.
According to the payment agreement, the participation fee is to be fully paid in euros, at least 3 days before the event starts, unless otherwise agreed. If the payment has not been made within the specified period, late payment fee applies to the contracting party. In this case, DeMedici is empowered to exclude the defaulted participant from the event.
If the participant needs accommodation, the payment for the same shall be made directly between the participant and the lodging establishment. Travel expenses and all other expenses, will be borne by the participant, unless stated otherwise in the event programme.
Besides the participation fee, the overall event fee also includes additional incidental material and design costs as well as the respective applicable Value Added Tax possible according to the offer.
§ 6 Copyright
DeMedici reserves all rights, also for the translation, the reprint and the reproduction of the event material and parts thereof. The event material or parts thereof may not be reproduced, copied, abused or used for communication to the public - neither handwritten nor in abbreviated form or by means of electronic equipment.
The participant further undertakes to respect intellectual ownership in the form of author's rights, Copyright, Trademark rights and similar rights.
§ 7 Duties of the participant and liability
The participant undertakes to attend the event regularly and in person, to appear punctually and to participate in the entire event.
The participant undertakes to submit confirmation of payment of the entry fees at the start of the event, unless otherwise agreed. If the participant cannot produce this, he/she shall not be eligible to participate in the event.
It is prohibited to bring along domestic animals to courses, lectures, exercises and other events.
The DeMedici events are structured such that an interested, attentive participant prepared for cooperation can achieve the objective of the event. DeMedici shall not be liable for the success of the training and complies with the stipulations in accordance with the General Terms and Conditions and the legal requirements.
The stay at the event premises is at your own risk. The liability of DeMedici is limited to deliberate acts and gross negligence. Furthermore, the participant undertakes to respect and adhere to the rules of the venue.
DeMedici shall not be liable for any theft, damage and abuse of valuables, photo and video cameras, mobile phones, credit cards, cash etc. Any responsibility for the non-compliance or partial compliance of the agreements with third parties for whom DeMedici acts as mediator, is excluded.
The legal provisions apply for all spheres of responsibility not contractually regulated, whereby these provisions of DeMedici should take precedence over the same.
§ 8 Miscellaneous
These Terms and Conditions are in no way detrimental to the common laws of the participant.
Should one or more provisions of this AGB be or become invalid, or if this contract text contains any loophole, the validity of the remaining provisions shall remain unaffected. In this case, the parties undertake to replace the clause by such a provision, which comes closest to the economic and legal sense of the invalid clause and the parties would have agreed, if they had known the invalidity of the provision.
In different countries, specific provisions apply for travel passes and visas. DeMedici requests the participants to make themselves familiar with these provisions and to abide thereby without involving DeMedici in other activities diverging from the subject matter of the contract .
§ 9 Amendments to the Scope of Services and the Conditions
Amendments or additions to the existing General Terms and Conditions are only valid, if they are in writing and signed by DeMedici.
Other Terms and Conditions are only valid if they are confirmed in writing by DeMedici.
DeMedici always reserves the right to make amendments in the existing Terms and Conditions and event data before any changes to the services, actions, in order to offer new services, in order to adapt to the legal provisions and regulations .
§ 10 Applicable Law and Jurisdiction
This contract is governed exclusively by Italian Law. Any disputes arising between the parties from the interpretation of the present contract are exclusive competence of the Court of Bolzano.
